The Act requires that farm land, or interests in farm land, are offered on the open market to people in New Zealand before they are sold to an overseas person, unless an exemption is sought by the applicant or a standing exemption applies.

Vendors should advertise farm land comprehensively and before entering into an agreement for sale and purchase with an overseas person. This will help ensure that the market is tested for New Zealand interest and that advertising complies with the requirements – 'do it once and do it right'.
