The Overseas Investment Office administers the New Zealand Government's foreign investment policies. The core work of the Office is to assess applications for consent from foreigners who intend making substantial investments in New Zealand.
How to present a consent application

The Overseas Investment Office is having increasing problems with the format of consent applications. Contrary to guidance on the Overseas Investment Office website, applicants continue to send in applications that are bound, or in ring binders, or contain other faults, such as the use of plastic sleeves or file dividers, which prevent easy use of the material by the Overseas Investment Office.
The Overseas Investment Office uses several electronic tools (including an electronic document management system) to assist with processing applications. In order to make use of these tools, the Overseas Investment Office requires an electronic copy of every application. If an application is not presented electronically, Overseas Investment Office staff must manually scan it. This time consuming process can delay the processing of applications.
Charging for legal advice

There is an increasing trend for lawyers acting for applicants to ask the Overseas Investment Office for advice on the interpretation of the Overseas Investment Act or about how the Act applies in relation to a particular fact situation. Assisting with these queries is time consuming, and diverts the Offices legal staff from application processing and other essential work. The Office considers that may be appropriate, particularly with regard to complex queries, to charge for this service. Under Part 5 of the Overseas Investment Regulations 2005, the Office may charge $120 per hour for the provision of services.
